
- All applicants intending to marry in New York State must both apply in person for a marriage license at any town or city clerk's office within their state. The legal age to obtain a marriage license without parental consent is 18 years of age. Under age 14, a marriage license cannot be issued. No other person can apply for the marriage license on behalf of the couple.
- A marriage license is valid for 60 days, beginning the day after it is issued. However, the marriage ceremony cannot take place within 24 hours from the exact time that the license was issued. This license can be used only within New York State. If you decide to go out of New York to be married, your New York State Marriage License will not be valid.
- No premarital examination or blood test is required for New York State.
- Fee Requirement: The fee for a marriage license issued in New York State outside of New York City costs $40.00. If the license is issued within the City of New York, the cost is $30.00. A marriage certificate will be sent (within 15 days after the completed license is return by the officiant) to the address indicated by the bride-to-be and groom-to-be when the license is issued. If Certificate of Marriage is not received within 4 weeks of your wedding - contact the town or city that issued the license.
- Applicants between the ages of 16 and 17 must present the written consent of both parents. One parent alone may consent to the marriage of a minor if, either, the parents are divorced and the consenting parent was given sole custody of the child when the divorce was awarded or the other parent is deceased. Parents or guardians consenting to the marriage of a minor must appear personally and give their consent before the town or city clerk. Anyone 14 and 15 years of age, must present the written consent of the jurisdicting judge in the town the application is made and have written consent of both parents - (see http://www.health.state.ny.us/nysdoh/consumer/vr/married.htm for further details).
- All applicants are required to submit documentary proof of age and identity. Two valid forms of Legal Identification are required, one of which must have a photo. These forms include any of the following: Current Driver's License, Non-Driver's License ID, Current Passport, Naturalization Papers (originals only), Current US Military ID, Employer's Photo ID, Birth Certificate (If under 21 - certificate must have raised seal), Baptismal Record. - A marriage may not take place in New York State between an ancestor and descendant, a brother and sister (full or half blood), an uncle and niece or an aunt and nephew, regardless of whether or not these persons are legitimate or illegitimate.
- If either applicant has been married before, a certified copy of the Decree of Divorce with Official Seal or a Certificate of Dissolution of Marriage is required and must be provided with the license application. If widowed, a certified copy of the death certificate must be presented.
